{"id":1795,"date":"2022-06-29T12:20:04","date_gmt":"2022-06-29T11:20:04","guid":{"rendered":"https:\/\/unit.law\/?p=1795"},"modified":"2022-06-29T13:47:41","modified_gmt":"2022-06-29T12:47:41","slug":"xz-v-yz-2022-ewfc-49-fam-reporting-restrictions","status":"publish","type":"post","link":"https:\/\/unit.law\/xz-v-yz-2022-ewfc-49-fam-reporting-restrictions\/","title":{"rendered":"Reporting Restrictions"},"content":{"rendered":"<p style=\"font-weight: 400;\">This decision follows not long after the case of <a href=\"https:\/\/www.familylawweek.co.uk\/site.aspx?i=ed229380\"><em>Xanthopoulos v Rakshina<\/em>\u00a0[2022] EWFC 30<\/a>, where Mr Justice Mostyn determined that in the absence of a specific order preventing publication of information in financial remedy proceedings, the status quo should be maintained.<\/p>\n<p style=\"font-weight: 400;\">In this case, H made an application for a Reporting Restriction Order (RRO) prior to the final hearing. W adopted a neutral position. Mostyn J applied the \u201cultimate balancing test\u201d identified within <em>Re S (A Child) (Identification: Restrictions on Publication)<\/em>\u00a0[2005] 1 AC 593. Essentially, there is a balance to be struck between ECHR, Articles 8, 6 and 10.<\/p>\n<p style=\"font-weight: 400;\">In summary, H\u2019s application requesting anonymity was made to limit the impact of any publication of the proceedings would have on his business, the business\u2019s commercial interests and on his business partner. H also argued that majority of the evidence that had been filed, had been done so on the basis that any sensitive information would remain anonymous. Having regard to H\u2019s position, Mostyn J made an interim RRO. Moreover, he decided that he would hear the substantive application and any opposing arguments from the press at the final hearing. The rationale for this decision, was to wait until the extent of the information concerning H\u2019s business had been disclosed during evidence at the final hearing.
